Purchase Terms and Order Acknowledgment
By placing an order with Modofire, you acknowledge and agree to the following terms.
Custom and Made to Order Products
Modofire products are custom designed, made to order, or produced in limited runs. Each piece is fabricated specifically for the purchaser based on the selected specifications, finishes, and dimensions.
Because of the custom nature of our work, all sales are final once production begins.
Pricing and Payment
Pricing reflects custom fabrication, materials, finishes, and production coordination specific to each order.
Payment is due in full prior to the start of fabrication unless otherwise agreed to in writing. Orders are not released into production until payment requirements are satisfied.
Production and Lead Times
Production lead times are estimates provided in good faith based on current schedules and material availability. Lead times are not guaranteed and may change due to fabrication sequencing, supply availability, or coordination requirements.
Modofire will communicate any material changes to timing as they arise.
Changes and Cancellations
Once an order enters production, changes may not be possible. Approved changes may result in additional costs and extended lead times.
Because products are custom or made to order, cancellations are not permitted once production has begun.
Shipping and Delivery
Shipping and freight coordination may be arranged by Modofire or the purchaser, depending on the order.
Title and risk of loss transfer at the time the product is released to the carrier unless otherwise agreed. The purchaser is responsible for inspecting shipments upon delivery and reporting any damage within a reasonable inspection period.
Installation, Fire, and Gas Compliance
Modofire does not perform installation unless explicitly stated in writing.
The purchaser is responsible for proper installation, site conditions, permits, inspections, and compliance with all applicable local codes and regulations, including fire, gas, electrical, and building requirements.
Fire features must be installed by qualified professionals in accordance with manufacturer instructions, local codes, and applicable safety standards. Modofire is not responsible for installation errors, site specific conditions, or code compliance determinations.
Use and Care
Products are designed for their intended environment and use as specified at the time of order. Natural variations in materials, finishes, and patinas are inherent to custom fabrication and are not considered defects.
Exposure to weather, heat, flame, and environmental conditions will affect appearance over time and is considered normal wear.
Warranties and Limitations
Warranty coverage, if applicable, is limited to the terms provided by Modofire or the original manufacturer of specific components. Burners, ignition systems, and related components may carry separate manufacturer warranties.
Modofire’s responsibility is limited to the product as supplied. Liability for indirect, incidental, or consequential damages is expressly excluded.
Order Acknowledgment
By completing this purchase, you confirm that you have reviewed and accepted these terms, understand the custom and made to order nature of the product, and acknowledge responsibility for installation, compliance, and use.
These terms apply to all Modofire orders placed online, by invoice, or through written approval.
